Governor Perry signs anti-polygamy bill

The Eldorado Success is reporting this week that Gov. Rick Perry signed Senate Bill 6 into law. For those who may not know, SB 6 includes the pertinent passages from HB 3006, sponsored by Rep. Harvey Hilderbran. The law goes into effect on Sept. 1, at which time it becomes a felony to have more than one wife, or to officiate over a polygamous marriage ceremony. There are lots of other things in the bill, such as raising the age of marriage in Texas from 14 to 16.

So, what happens if you officiate a marriage (celestial or not) in another state, or country then move to Texas? What do the laws say about that? Where there is a will, there is a loop hole.

What I would like to know is how they plan on prosecuting crimes they don't know about, when they don't prosecute the crimes they know about?

This is the same problem in every state, province and country where people live polygamy. First of all regular Child Protective Service laws don't pertain the same way to polygamous people i.e. Dan Barlow Junior being given a very limited sentence and community service for molesting 5 daughters in CC when around the same time a 47 year old man in Kingman was given 45 years for having sex with a 15 year old girl who had been left with him when she was 11??? Also they can legislate till the cows come home and no one will be able to nail Warren Jeffs for marrying underage girls if the girls won't talk, the families won't talk, and they are locked in a compound noone can get into and get a proper head count --let alone find out who is the father of which babies.

Let's spell out the "very limited sentence" Dan Barlow, Jr. received for molesting these young girls.

It was 13 DAYS --- YES DAYS -- less than 2 weeks - 13 DAYS - time served - for molesting 4 girls - all under 15 years old.


From the St. George Spectrum newspaper:

Judge Richard Weiss imposed a 120-day jail sentence but suspended all of that, granting credit for the 13 days Barlow had already spent in jail.

Barlow, son of 17-year Colorado City Mayor Dan Barlow Sr., must register as a sex offender and perform 500 hours of community service. Weiss also placed Barlow on supervised probation for seven years.

Court records show that arresting deputy Sam Roundy said Barlow admitted initial allegations of improper sexual contact with the five girls. Only instances involving four of the girls were charged in the indictment returned by a grand jury.


And, this is the SAME Judge Richard Weiss who sentenced this non-polygamist guy to 45 YEARS

But, the prosecutor in the Dan Barlow, Jr. case, Matt Smith, was quoted as having said "They like to handle things their own way up there".

That was always a favorite comment made by the Colorado City Ex-Mayor and the convicted pedophile's father, Dan Barlow, Sr. He was so quick to tell people how the polygamists took care of things in their own way.

Yea, right, they close their eyes and everything is taken care of.

Well as the stories go, Warren will just go to another state, exampled by his trips to Caliente Hot Springs in Nevada, perform an out of state marriage and return. In the end it takes Utah, Arizona, Texas, Idaho, Nevada and few others all reading from the same page to make it work.

One more requirement brave witnesses willing to come forward!

Ummm, Utah signed their "Anti Polygamy bill" how long ago. The Feds have had theirs for a short time, about a 100 YEARS!

Has any one checked the states registry to see if Jr. or the local PD have complied? Some time back when someone I know was checking, Colorado City had none registered. I think in reading prior postings others have listed the names of convicted sex offenders on this blog.

Go to the state sites and enter zip codes for Hildale and Colorado City then tell us all who is found!!!

OK - first I have to comment that on the left navigation bar of this website it states 'Help Offenders Succeed'. I just want to know who 'the brain' is that thought up that title.

I could only find 2 offenders in Colorado City (Rodney Holm and John Roy Jessop) - I didn't see a 17 year old.

LOL! Atari, the wording was funky, but what they were trying to say, is the man that committed the crimes was the son of the mayor who had served 17 years in the mayor capacity! See what a poor choice of words can do to the facts! Ya gotta laugh.

Sounds like all that Texas did was sign a law which catches them up to the rest of the world. If they think that it will make a bunch of difference then they will have to tackle the gay issue as well. Consenting adults have a right to privacy. So do dog lovers. Nice picture of a dog on your desk gov. Siccum!!!

Better work on it a little harder, I don't think this ball will stop rolling until YFZ looks like Hayden Lake does.

It belongs to a human-rights group - the Carr Foundation - but it used to be a 20 acre complex owned by the aryan nations (until they lost a 6.3 million dollar judgement). 6.3 million dollars to a woman and her son who were attacked outside their headquarters by aryan nations guards.

Imagine what jeffs will owe?

Reading this thread makes me wish that I took the local paper, since I've heard nothing about this new law against polygamy in Texas. "Course our local paper up here in NE Texas isn't all that good. Sad to see that even Gov. Perry can be swayed to ignore Bill of Rights, ie Freedom of religion.

I checked this out at the official Texas State website, and if I understand this correctly, the bill that you're talking about is HJR06. This is a bill that simply states that a state marrige consists of One man and one woman. This will be on the Nov. ballot for adoption into the state constitution. If this is right, then we have some opportunities for grass roots action to defeat this change to the constitution.
